What does VietnamLitigation.com cover?

VietnamLitigation.com explains how disputes involving foreigners and foreign businesses are resolved in Vietnam. It covers labour, commercial, civil, intellectual property and administrative disputes, including the choice of forum, compulsory pre-trial steps, limitation periods, interim measures, trial stages and enforcement of judgments and awards.

Can VietnamLitigation.com tell me whether I will win my case?

No. The site provides general information and does not assess individual disputes or predict outcomes. Results depend on evidence, deadlines and how a claim is presented. For an assessment of your own position, you should consult a lawyer licensed to practise in Vietnam.

Do commercial disputes in Vietnam have to go to court?

No. If the parties have a valid arbitration agreement, a commercial dispute can be resolved by commercial arbitration, and the award is final and binding, subject to limited grounds for annulment by a court. Without such an agreement, the dispute is generally heard by a Vietnamese court. Mediation is also available at any stage.

How long do I have to bring a claim?

It depends on the type of dispute. For example, the Civil Code sets a three-year limitation period for contract disputes, the Commercial Law sets two years for many commercial claims, and an individual labour dispute generally must be brought within one year. The exact starting date matters, so it should be checked early.

Where does the content come from and how is it updated?

Articles are based on the Civil Procedure Code, the Law on Administrative Procedure, the Law on Commercial Arbitration and related laws and court guidance. When procedures or court structures change, as with the 2025 replacement of district-level courts by regional people's courts, the relevant articles are revised.

Is there a fee for using the site?

Reading articles and sending questions or corrections is free. If a dispute is referred to a partner lawyer for review or representation, any fee is agreed directly between you and that lawyer before work starts, and you remain free to decide not to go ahead with the referral.

How do I report an error in an article?

Use the contact page to send the article address and a description of the problem, citing the legal provision or court decision you rely on if possible. The editorial team reviews each report and updates the article when the correction is justified, so later readers see the corrected text.
